Resumen:

El objetivo fundamental de este artículo es realizar un análisis de los aspectos centrales vinculados con el acceso al derecho humano al agua potable (limitado al consumo humano), en el ámbito del nuevo Código Civil y Comercial de la Nación de Argentina que tiene vigencia desde el 1° de agosto de 2015. En su desarrollo se analizarán los aportes del Derecho Internacional Público respecto del derecho humano al agua, la jurisprudencia, la normativa de Argentina, y los aspectos centrales aportados por el nuevo Código Civil y Comercial de la Nación de Argentina. Preliminarmente podemos concluir que el derecho en estudio no puede de ninguna manera ser divorciado de nuestra Constitución, ni del Derecho Internacional, ni del nuevo Código. El derecho

Resumen:

La STC 270/2015 sobre el nuevo sistema retributivo de las energías renovables ha declarado su constitucionalidad rechazando que se hayan vulnerado los principios de seguridad jurídica y de confianza legítima. No obstante, estos principios han quedado seriamente debilitados al demostrar su incapacidad para limitar una mutabilidad legislativa tan vertiginosa, incoherente y caótica como la producida en el sector de las energías renovables.

Resumen:

Este trabajo examina varias cuestiones sobre las inspecciones en material de medio ambiente. Para ello se analizan algunas de las principales normas del Derecho de la Unión Europea. También se exponen algunos datos sobre la aplicación de tales normas por las Comunidades Autónomas. A pesar de la importancia de las inspecciones, los datos que se han podido obtener no presentan un panorama coherente al respecto.

Abstract:

The present contribution examines the role of environmental inspections. It analyses some of the basic EU rules. It also presents some data concerning the application of those rules by the Spanish Autonomous Communities. Despite the important role of inspections the data submitted by the Communities do not reflect a coherent framework.

Abstract:

This study aims to highlight the important role of the Amazon Cooperation Treaty – ACT for the management of the Amazon shared river basin. There are challenges in the organizational and operational structure that need to be address. This article also focus on the major historical milestones during the 35 years of the treaty, which represent a breakthrough for shared water management in the region. In the last part, the rules and principles of internal and international law applicable to the ACT countries are analyzed. It concludes that, on one hand, it is important updating the internal laws of water management in the Amazon countries, and on the other, it is also important the adaptation to general principals of international law, and more specifically, to integrated and participatory principles in the field
