Resumen:
El presente trabajo analiza la respuesta del Derecho penal europeo al tráfico ilegal de residuos plásticos, en el marco de la Directiva (UE) 2024/1203 relativa a la protección del medio ambiente mediante el Derecho penal. El objetivo del estudio es evaluar si las reformas legislativas recientes en la Unión Europea son suficientes para cumplir con el mandato de criminalización del Convenio de Basilea y afrontar los desafíos vinculados a este fenómeno delictivo transnacional. Los principales resultados del análisis muestran que la nueva Directiva es un avance significativo respecto a la anterior normativa (Directiva 2008/99/CE) por su novedoso enfoque holístico. Así, cabe destacar que la Directiva modifica los delitos de residuos e introduce mejoras notables en cuanto al sistema de sanciones penales, el fortalecimiento de la responsabilidad penal de las personas jurídicas y el fomento de la cooperación entre autoridades. La investigación concluye que, si los Estados miembros de la UE transponen la Directiva conforme al enfoque holístico que ésta propone, podrá convertirse en una herramienta eficaz para combatir el tráfico ilegal de residuos plásticos en la UE con efectos a nivel global.
Abstract:
This study examines how European criminal law addresses the illegal trafficking of plastic waste in the context of Directive (EU) 2024/1203 on the protection of the environment through criminal law. Its purpose is to determine whether recent legislative reforms in the European Union are adequate to fulfil the Basel Convention’s mandate on criminalisation and to tackle the challenges posed by this transnational criminal phenomenon. The analysis highlights that the new Directive marks a substantial improvement over the previous framework (Directive 2008/99/EC), primarily due to its innovative holistic approach. Notably, it revises waste-related offences and introduces significant improvements regarding the system of criminal sanctions, the strengthening of corporate criminal liability, and the promotion of cooperation among authorities. The study concludes that as long as EU Member States transpose the Directive in line with its holistic approach, it has the potential to become an effective instrument against the illegal trafficking of plastic waste within the EU, with meaningful global impact.
