Resumen:
Este comentario analiza la sentencia del TJUE en el asunto C-236/24, Provincie Oost-Vlaanderen y Sogent v. KG y WA, relativo a la obligación de separación funcional en el caso de la evaluación de impacto ambiental bajo la Directiva 2011/92, cuando el mismo órgano encargado de esta sea, a su vez, promotor del proyecto de que se trate. El comentario destaca la conclusión del Tribunal de Justicia de la Unión Europea de que para garantizar las obligaciones de la Directiva tal separación ha de ser real.
Abstract:
This comment analyses the judgment of the CJEU in Case C-236/24, Provincie Oost-Vlaanderen and Sogent v KG and WA, concerning the obligation of functional separation in the case of environmental impact assessments carried out under Directive 2011/92, where the same body responsible for the assessment is also the developer of the project in question. The comment highlights the conclusion of the Court of Justice of the European Union that such separation must be effective in order to ensure compliance with the obligations of the Directive.
