Resumen:
El presente estudio tiene como objetivo analizar la Opinión Consultiva 32/25 de la Corte Interamericana de Derechos Humanos, la cual es la pionera al reconocer el derecho al clima sano como un derecho humano. Para ello, se abordará brevemente el sistema normativo en el que se inserta esta Corte, así como el contexto jurisprudencial previo al desarrollo de esta Opinión. A continuación, se presentarán de manera general los trámites procesales, las principales cuestiones planteadas a la Corte y un resumen de las respuestas emitidas. Este trabajo se detendrá con mayor detalle en los apartados relativos al reconocimiento del derecho al clima sano y de la naturaleza como sujeto de derecho, así como las obligaciones que se derivan. Se reconoce como novedoso el énfasis dado por este Tribunal a las obligaciones de los Estados de establecer medidas concretas de mitigación y adaptación que también alcancen las actividades empresariales y protejan los ecosistemas compartidos. Se destaca la obligación de prevención proactiva mediante la debida diligencia reforzada basada en criterios científicos, así como la obligación de progresividad, ambas ancladas en principios como la equidad intra e intergeneracional, la responsabilidad común pero diferenciada y la justicia climática. Se concluye que, aunque esta Opinión tenga carácter consultivo y no sea jurídicamente vinculante, establece una interpretación sólida del derecho internacional que puede orientar futuras acciones y decisiones judiciales, no solo en los países del continente americano, sino también con repercusiones a nivel global en el ámbito de la justicia climática.
Abstract:
This study aims to analyze Advisory Opinion 32/25 of the Inter-American Court of Human Rights, which is the pioneer in recognizing the right to a healthy climate as a human right.. To this end, it will briefly address the normative system within which this Court is embedded, as well as the jurisprudential context prior to the development of this Opinion. The following section will provide an overview of the procedural steps, the main questions posed to the Court, and a summary of the responses issued. This paper will focus in greater detail on the sections relating to the recognition of the right to a healthy climate and of nature as a subject of law, as well as the obligations arising from it. The Court’s emphasis on the obligations of States to establish concrete mitigation and adaptation measures that also extend to business activities and protect shared ecosystems is recognized as innovative. The obligation of proactive prevention through enhanced due diligence based on scientific criteria is highlighted, as is the obligation of progressiveness, both anchored in principles such as intra- and intergenerational equity, common but differentiated responsibility, and climate justice. It is concluded that, although this Opinion is advisory and not legally binding, it establishes a solid interpretation of international law that can guide future judicial actions and decisions, not only in the countries of the American continent but also with global repercussions in the field of climate justice.
