Resumen:
La reciente jurisprudencia chilena ha calificado a la responsabilidad ambiental en función de la reparación material del daño, descartando una indemnización de perjuicios. Aunque esta interpretación tenga por finalidad favorecer restablecimiento del ambiente, otorgando facultades a los Tribunales Ambientales en ámbitos diversos, diferentes limitaciones sustanciales y procesales dificultan su concreción. Estos límites pueden superarse en base a una lectura alternativa, que distinga una multiplicidad de responsabilidades frente al daño ambiental y una unidad en su reparación, impuesta cualquiera sea la ley aplicable.
